Montgomery County Court of Common Pleas

The Montgomery County Court of Common Pleas is the general jurisdiction trial court for the county. It has a General Division, a Domestic Relations Division, a Juvenile Division, and a Probate Division. The Domestic Relations Division handles all divorce, dissolution, legal separation, and annulment filings. It also rules on child custody, parenting time, child support, and spousal support. Each case generates family court records that stay on file with the Clerk of Courts.

Under ORC Chapter 3105, Ohio has 11 grounds for divorce. Incompatibility is by far the most common. To file in Montgomery County, the plaintiff needs six months of Ohio residency and 90 days of county residency. Property gets divided under equitable distribution rules in ORC 3105.171. The court weighs the duration of the marriage, each party's income and assets, retirement benefits, and the tax consequences of any division. Montgomery County sees a large number of filings each year because of its population size. The Domestic Relations Division has dedicated judges and magistrates to keep the docket moving.

Montgomery County Clerk of Courts

The Clerk of Courts maintains all case filings from the Montgomery County Court of Common Pleas. Every petition, motion, response, and judgment entry is stored by the clerk's office. Family court records from the Domestic Relations Division are public records unless a judge has sealed them. The staff can search by party name or case number and pull documents on request.

Standard copies cost $0.10 per page. Certified copies have an extra charge. Ohio's Public Records Act (ORC 149.43) gives anyone the right to request public records. You do not need to state your name or give a reason. The office must produce documents at cost within a reasonable time. A denied request must come with a written explanation citing the legal authority for the denial. If you believe the denial was wrong, the Ohio Court of Claims hears complaints for a $25 filing fee.

Dayton Municipal Court

The Dayton Municipal Court is a separate court that serves Dayton and surrounding areas. It handles civil cases, small claims, and certain misdemeanor matters. While the Municipal Court does not hear family law cases like divorce or custody, it does process protection orders and some domestic violence-related criminal cases. Five full-time judges serve on the bench, elected to six-year terms. Magistrates handle civil and small claims cases.

Montgomery County Probate Court Records

The Montgomery County Probate Court handles estates, guardianships, adoptions, name changes, marriage licenses, and mental health commitments. Marriage licenses require both parties to appear in person with valid photo ID. The court processes a large volume of marriage license applications each year given the county's population.

The Juvenile Division hears cases about minors including delinquency, unruly behavior, abuse, neglect, and dependency. Under ORC Chapter 2151, juvenile records are confidential. You cannot access them without a court order. Montgomery County's Juvenile Court has its own building and staff dedicated to handling youth cases. Guardianship cases require yearly status reports to the court.

Standard copies cost $0.10 per page. Certified copies have added fees. Divorce filing fees in Ohio run from $200 to $400. Dissolution is often cheaper than contested divorce. Montgomery County's Probate Court has its own fee schedule for marriage licenses, certified copies, and estate filings.

If you cannot afford the fees, ask the court about a fee waiver. You file a poverty affidavit showing your income and expenses. A judge reviews it and decides whether to waive the costs.
