Greene County Court of Common Pleas

The Greene County Court of Common Pleas is the main trial court. The Domestic Relations Division handles all divorce, dissolution, legal separation, and annulment cases. It also processes child custody, parenting time, child support, and spousal support matters. When divorcing parents have minor children, the court requires parenting classes. Greene County Clerk of Courts

The Greene County Clerk of Courts is the official record keeper for the Court of Common Pleas. This includes files from the General Division, Domestic Relations Division, and Probate/Juvenile Division. Every document filed in a case goes through the Clerk's office. Both people must appear in person with valid ID to get a marriage license. The license is valid for 60 days. Certified copies of marriage certificates are available at a small cost. Guardianship cases require background checks and ongoing yearly reports. Under ORC Chapter 2101, the Probate Court has original jurisdiction over these matters.

Divorce and Dissolution in Greene County

Divorce cases in Greene County go through the Domestic Relations Division. Under ORC Chapter 3105, Ohio has 11 grounds for divorce. These include adultery, extreme cruelty, gross neglect of duty, habitual drunkenness, and living apart for one year. The person filing must have been an Ohio resident for at least six months. Property gets divided under equitable distribution rules in ORC 3105.171.

A dissolution is different from a divorce. Both people agree on all terms before filing. This includes how to split property, custody of children, and support amounts. The process tends to be faster. The court holds one hearing. If everything checks out, the judge grants the decree. Spousal support is determined after property division under ORC 3105.18. The court looks at each person's income, the length of the marriage, and other factors.

The full case file for a divorce or dissolution includes the petition, the answer or waiver, financial disclosures, any temporary orders, and the final judgment entry.
