Fayette County Clerk of Courts

The Fayette County Clerk of Courts keeps all records for the Court of Common Pleas. This includes files from the General Division, Domestic Relations Division, and Probate/Juvenile Division. Divorce and Dissolution in Fayette County

Divorce and dissolution cases in Fayette County are filed through the Domestic Relations Division. Under ORC Chapter 3105, Ohio recognizes 11 grounds for divorce. These include adultery, extreme cruelty, gross neglect of duty, habitual drunkenness, and living apart for at least one year. Incompatibility is also a ground, but the other spouse can deny it. The person filing must have lived in Ohio for at least six months before they file.

A dissolution is different from a divorce. Both sides agree on everything before they file, including property division, custody, and support. Dissolution tends to be faster and cheaper. The court holds one hearing and grants the decree if everything is in order. Divorce cases, on the other hand, can take much longer if the parties disagree on terms. Property gets split under equitable distribution rules found in ORC 3105.171. The court looks at several things when dividing assets, like how long the marriage lasted, what each person earns, and custody of the children.

Spousal support in Fayette County is decided after property division. Under ORC 3105.18, the court can award support to either party based on need and ability to pay.

Custody and Child Support Records

Child custody cases in Fayette County follow ORC Chapter 3109. The court uses the best interest of the child standard when making custody decisions.
