Divorce Records in Logan County

Divorce cases in Logan County go through the Domestic Relations Division. Ohio allows 11 grounds for divorce under ORC 3105.01. Incompatibility is by far the most common. Living apart for one year is another option. The plaintiff must have been an Ohio resident for at least six months before filing the complaint.

Property division follows equitable distribution under ORC 3105.171. The court splits marital property equally unless it finds that would be unfair. It looks at the length of the marriage, each person's assets and liabilities, custody of the children, and tax effects. Separate property stays with its owner. Spousal support is handled under ORC 3105.18 after the property division is complete. Dissolution is an alternative where both spouses file together after agreeing on all terms. It is usually faster and costs less.

Logan County Custody and Support Cases

Custody cases follow ORC Chapter 3109. The court uses the best interest of the child standard. It weighs the wishes of each parent, the child's attachment to family, adjustment to school and home, and the health of everyone. Ohio calls the primary parent the "residential parent" in most situations.

Shared parenting plans are available. Each plan must contain the elements required by statute. Child support follows state guidelines. Parenting time orders lay out the schedule. Grandparents and other relatives can ask for visitation rights under ORC 3109.051 if they can show it serves the child's best interest.

Juvenile cases are handled in the Juvenile Division. Under ORC Chapter 2151, juvenile records are mostly confidential. Ohio extends juvenile court jurisdiction for unruly children until age 21.

Court Forms and Fees

The Supreme Court of Ohio provides standardized forms for domestic relations cases. All 88 Ohio counties must accept them. These include affidavits, divorce complaints, shared parenting plans, and judgment entries. Logan County may require extra local forms. Filing fees for divorce in Ohio usually range from $200 to $400. Dissolution tends to cost less. Copy fees are $0.10 per page for standard copies. Certified copies cost more. Under ORC 2101.16, probate court fees include $20 for adoption petitions and $20 for name changes. Fee waivers are available if you qualify based on income.
