Accessing Holmes County Court Records

The Holmes County Clerk of Courts is the official custodian of all court documents. Every petition, motion, order, and decree filed in a family case goes through this office. The Clerk indexes each document and stores it in the case file. If you need copies of a divorce decree, custody agreement, or child support order, you request them from the Clerk.

Ohio's Public Records Act (ORC 149.43) gives everyone the right to request public records. You do not need to state your name or your reason for wanting the documents. The office must provide copies at cost within a reasonable time. Standard copies cost about $0.10 per page. Certified copies cost more. If your request is denied, the office must explain why in writing and cite the specific legal authority. You can challenge a denial through the Ohio Court of Claims for a $25 filing fee.
