Divorce and Dissolution in Gallia County
Divorce and dissolution cases in Gallia County go through the Domestic Relations Division. Under ORC Chapter 3105, Ohio recognizes 11 grounds for divorce. The most common ground cited is incompatibility, though the other spouse can deny it. Other grounds include adultery, extreme cruelty, gross neglect of duty, and living apart for one year. The person who files must have lived in Ohio for at least six months.
A dissolution is different. Both sides agree on everything before they file. This includes property division, custody, and support. It tends to be quicker and cheaper. Property gets split under equitable distribution rules in ORC 3105.171. The court looks at the length of the marriage, what each person earns, and other factors. Spousal support comes after property division under ORC 3105.18. The full case file, from the initial petition to the final decree, is stored as a family court record by the Clerk of Courts.
Custody and Child Support Records
Child custody in Gallia County follows ORC Chapter 3109. The court uses the best interest standard. Shared parenting is an option. The court weighs the wishes of both parents, the child's wishes if old enough, how the child is adjusting to home and school, and each parent's health. An unmarried mother is the sole custodian until a court rules otherwise under ORC 3109.042.
Child support uses Ohio's income shares model. Both parents' incomes go into the math. Support orders can be changed if circumstances change in a big way. The Gallia County Child Support Enforcement Agency helps collect and track payments.
Note: Juvenile records in Gallia County are not public under ORC Chapter 2151 and need a court order to access.
