Parma Family Court Legal Framework
Ohio divorce law is set out in ORC Chapter 3105. To file in Cuyahoga County, at least one spouse must have lived in Ohio for six months and in the county for 90 days. Ohio recognizes 11 fault grounds for divorce plus no-fault options. Dissolution requires both parties to agree on all terms before filing. Property is split using equitable distribution under ORC 3105.171, which does not always mean 50/50.
Child custody in Ohio follows ORC Chapter 3109. Courts use the best interest of the child standard to make custody decisions. Factors include each parent's wishes, the child's relationship with each parent, the child's adjustment to home and school, and the mental and physical health of all parties. Parenting time schedules are set by the court and can be modified if there is a change in circumstances.
Protection orders for domestic violence fall under ORC 3113.31. These are civil orders separate from any criminal charges. A person can file for a protection order at the Domestic Relations Division. The court can grant a temporary order the same day and schedule a full hearing within seven to ten days. Violations of protection orders are criminal offenses.
